HOW TO CLAIM FROM THE COMPENSATION FUND IF YOU ARE A WORKER

The Compensation for Occupational Injuries and Diseases Act gives workers the right to claim compensation if they were injured or go ill at work.

Claiming:

When workers want to claim they must use the following steps:

Step 1: Fill in the form

Workers must report their injury or disease to their supervisor or employer immediately. Their employer must report it to the Compensation Fund and send in the necessary forms.

Step 2: Get forms from the doctor

Workers must get the W.Cl.2 or W.Cl.1 form from their employer and take it to the doctor when they go for a visit. After the doctor has filled in the form, workers must take it back to their employer.Workers must take any other forms the doctor gives them to their employer.

Step 3: Keep in touch with the employer

Workers must let their employers know when their address change and keep in touch with them. Workers’ money will be send to their employer’s address, so it is important that their employer can find them.If employers do not send in the forms or the claims takes long, workers must contact the nearest labour centre and report it.

Employers must send the necessary forms with the doctors report to the Compensation Fund when accidents occur.

All employers must report all occupational diseases within 14 days.

This form must be completed when reporting an occupational disease of a worker.

A form to be completed when reporting on the progress or the final medical report for an occupational disease.

>>  Form W.CL.3 - Notice of Accident and Claim for Compensation

A notice of an accident and claim for compensation which must be completed by a worker or on their behalf.

>>  Form W.CL.303 - First Medical Report in Respect of Post Traumatic Stress Disorder

A form for reporting post traumatic stress disorder related to work activities by a medical practitioner.

>>  Form W.CL.304 - Final or Progress Medical Report in Respect of Post Traumatic Stress Disorder

A form used for a final or progress medical report for post traumatic stress disorder.

>>  Form W.CL.305 - Employee Affidavit for an Occupational Disease

This form must be completed by or on behalf of a worker for an occupational disease.

>>  Form W.CL.4 - First Medical Report in Respect of an Accident

The first medical report for an accident completed by a medical practitioner.

>>  Form W.G.30 - Application for Additional Compensation

An application form for additional financial assistance from the compensation fund.
